Section 28
Preparing shortlist of candidates
(1) The party that wants to participate in the election to be held according to the proportional election system must prepare a closed list of candidates representing their party.
(2) According to sub-section (1), when the party prepares the closed list of candidates, the closed list shall be prepared for at least ten percent of the total number of members to be elected under the proportional election system.
(3) When the party prepares the closed list of candidates, at least fifty percent of the total candidates should include the names of women.
(4) When preparing the closed list of candidates, the party shall not include the name of the candidate in such a way that it exceeds the total number of members determined for the proportional election system.
(5) While preparing the closed list of candidates in accordance with this clause, the party shall also take into account the geographical and regional balance and prepare it according to the principle of inclusiveness so that Dalits, tribal tribes, Khas Arya, Madhesi, Tharu and Muslims are also represented on the basis of population as mentioned in Schedule-1. .
(6) When the party prepares the closed list of candidates, it should be done in such a way that backward areas and persons with disabilities are also represented.
(7) When the party prepares the closed list of candidates, it shall be prepared in the prescribed format in such a way that the candidates included on each inclusion basis are separated according to sub-section (5).
(8) The party shall submit the closed list of candidates prepared in accordance with this section to the commission within the time specified in accordance with sub-section (3) of section 7. After submitting the closed list to the commission, it will be considered that the candidate has been nominated.
(9) When submitting the closed list of candidates according to sub-section (8), the person whose name is included in such closed list must also submit the permission letter that he has agreed to be a candidate on behalf of that party.
(10) According to sub-section (8), the Commission shall ascertain whether the closed list of candidates received from the party has been prepared in accordance with this Act and if it is not prepared accordingly, the Commission shall inform the concerned party to correct it within seven days.
(11) After being notified by the commission to correct the closed list of candidates in accordance with sub-section (10), the broker concernedAccordingly, the closed list of candidates should be amended and sent to the commission within seven days.
(12) In the event that a closed list of candidates has been submitted in accordance with sub-section (10) but the election has not been completed, if a candidate dies, the party shall include another candidate in such closed list and nominate a candidate. In this way, the candidate who died while nominating the candidate should be nominated on the same inclusive basis as the other candidate.
